Biography

Jennifer Smith is Special Counsel in the firm's Litigation Practice Group in Los Angeles. Ms. Smith focuses her practice primarily on representing financial institutions and corporate clients, specializing in pre- and post-judgment remedies, workouts and general business-related matters. Ms. Smith is also experienced in unlawful detainer prosecution and defense, and in defending worker’s compensation/ Labor code 132a claims. She is counsel to more than 90 credit unions throughout California.

Representative Matters

  • Counsels bank and credit union clients on obligations under the California and Federal Fair Debt Collection Practices Act;

  • Successfully represented financial institutions in more than 25 bench trials;

  • Handles defense of labor code 132a claims for multiple clients in various industries; and

  • Handles prosecution and defense of unlawful detainer action for both residential and commercial, pre- and post-foreclosure for clients in various industries.

    Ms. Smith regularly speaks at various credit union chapter meetings on issues of Rees-Levering, vehicle lien laws, garageman’s liens, Fair Debt collections Practices Act (Federal and State), indirect and direct loans, and California’s anti-deficiency laws. She also presents educational seminars for attorneys on Judgment Debtor Examinations, Writs of Possession and Writs of Attachment. She co-authored "When Should You File a Form 1099-C?" Points & Authorities, 2000.

    Ms. Smith earned her J.D. at Loyola Law school in 1996 and her B.A. in Communications cum laude at the University of Arizona. She studied law at Oxford University in the summer of 1994 as part of her law school education. Prior to law school, she interned for Vice President Joseph Biden in Washington, D.C.
