Attorneys

Knowledgeable, skilled and always one step ahead in the ever-shifting, competitive intellectual property landscape, describes the Buchalter Nemer highly specialized team of intellectual property attorneys.

The IP Practice Group’s goal is to help its national and international clientele realize the full value of their intellectual property assets. We do this by devising thorough, forward thinking protective measures that account for and anticipate the demands of domestic and international markets.

We are engaged to handle IP issues by a diverse array of industries, from traditional businesses such as apparel, jewelry, finance, hospitality, consumer goods and services, and automotive, to knowledge-based industries in the fields of semiconductors, electronics, chemicals and chemical intermediates, waste/sludge management and conversion, fibers, biotechnology, pharmaceuticals, computer software, technology and telecommunications. We provide intensive strategic counseling, manage the full range of IP transactions, and engage in patent and trademark prosecution and litigation to keep our clients ahead of the curve in domestic and international IP markets.

IP Prosecution
We aggressively and thoroughly prosecute patent and trademark applications for our clients. Our team of patent and trademark professionals prepare and file patent and trademark applications, file divisionals, continuations and RCE applications, conduct application interviews with the USPTO, prosecute appeals and reexaminations and educate our clients on recent updates and rule changes at the USPTO. We also handle PCT and foreign patent applications for our
clients. Our attorneys have prosecuted hundreds of patent and trademark applications to issue, as well as keeping our clients informed with respect to possible infringers and competitors.

IP Licensing and Assignments
We cut through the red tape. From safeguarding designs to protecting technology, we meticulously protect our clients’ businesses, images, technology, brands and names. We regularly counsel business entities—whether established or newly-formed—to capture domain names, trademarks, trade secrets, service marks, copyrights and licenses, including software licensing.

IP Litigation
We represent both plaintiffs and defendants in business IP conflicts involving piracy, cybersquatting, identity thefts and counterfeiting. We’ve prevented the misuse of celebrity images, shut down counterfeit websites and resolved a patent feud between the world’s top physicists over detection technology.

IP Audits and Counsel
To enhance business value, our team conducts intellectual property audits for a wide range of matters. Our evaluation of IP assets owned by borrowers, buyers and sellers provides key information for venture capital group investments, loan transactions by financial institutions, and merger and acquisition deals. Our attorneys are experts at providing a birds-eye view of potential investments. We also routinely counsel new product inventors and work hard to protect their commercial interests.
