
Evan Goldstick is a Special Counsel in the Firm’s Chicago office and a member of the Litigation practice group. He maintains a broad-based commercial litigation practice, representing public and private companies in state and federal courts. His diverse experience includes antitrust and securities matters, as well as civil class actions. Mr. Goldstick has also handled white collar criminal defense work and internal investigations. In his active pro bono practice, he has previously represented a successful habeas corpus petitioner and tenants in a housing action.

- Successfully represented a California pain management practice, including a surgery center, principals, and physicians, in resolving qui tam actions pursued by State Farm under California’s Insurance Frauds Prevention Act with alleged damages exceeding $20 million, including conducting internal investigation into allegations.
- Ongoing representation of energy company and its executives against putative class action filed in the Southern District of New York and subsequent arbitration alleging consumer fraud violations based on variable rates and marketing materials, including successfully compelling arbitration.
- Ongoing representation of an energy company and its CEO against a putative class action alleging RICO and consumer fraud violations based on slamming allegations in the Eastern District of New York with alleged damages exceeding $15 million, including briefing on motion to dismiss and obtaining order from court staying discovery.
- Ongoing representation of an environmental services and energy refining company against putative securities class action litigations brought by shareholders in Alabama and Texas federal courts with alleged damages exceeding $350 million, including conducting initial investigation and successfully obtaining consolidation and transfer of venue into the Southern District of Texas, and derivative suits brought by shareholders in Texas federal court and Nevada and Texas state courts. Representation also includes review of company policies and controls and developing new policies.
- Successfully represented former CFO of division of public construction company with international operations against federal agencies investigations related to company’s revenue recognition and accounting practices following restated financials. Investigations were conducted by U.S. DOJ, resulting in no further action, and SEC, resulting in negotiated order that did not include fraud-based charges initially pursued by SEC and nominal fine.
- Represented a credit investment and specialty finance firm in bringing an action in the Southern District of New York that successfully obtained the appointment of a receiver over an entity it loaned $200 million to that defaulted on multiple loan and promissory agreements, was becoming insolvent, but maintained significant assets that the firm sought to protect from further devaluation.
- Represented officer of autonomous-driving car company in connection with state agencies and regulators’ investigation into company and officer’s separation from company, which resulted in no adverse governmental actions against client and included successfully obtaining indemnification for client from company.
- Successfully represented an international mining company in resolving a putative securities class action litigation brought by shareholders in the Eastern District of New York with alleged damages exceeding $400 million, including in motion to dismiss briefing, mediation, and settlement negotiations.
- Successfully represented energy client involved with joint venture to construct and maintain a trans loading station to supply a major American airline company with jet fuel in connection with commercial litigation in the Eastern District of Pennsylvania containing claims of fraudulent transfer and various breaches of contract, with representation including summary judgment briefing that was granted in part leading to a narrower set of issues for trial.
- Advised energy client that provides energy to multiple municipalities in the Gulf Coast region on potential methods to unwind complex energy-sharing agreements.
- Represented consumer-packaged goods (over-the-counter health care and household cleaning products) and marketing company in commercial litigation dispute in the Southern District of New York involving claims brought by company against their third-party warehouse provider and related logistics issues with alleged damages exceeding $30 million. Representation included briefing and arguing all aspects of fact discovery, including taking and defending over a dozen depositions, subpoena disputes, and managing document and information productions.
- Successfully represented solar panel company in connection with subpoena from New Jersey Attorney General’s Office, Division of Consumer Affairs, resulting in limited document production and no further action by state agency.
- Successfully represented individuals and firm serving as joint voluntary liquidators in bankruptcy initiated in the Cayman Islands in connection with bankruptcy suit brought in the Southern District of New York by principal of insolvent fund, including briefing several motions to dismiss suit. Representation concluded with the court granting dismissal of all claims with prejudice.
- Successfully represented American subsidiary of international infrastructure company in connection with putative securities class action brought by shareholders in the Southern District of New York on theory that company omitted material information related to one of its largest storage facilities, with representation including multiple rounds of motions to dismiss and a potential landmark ruling before the U.S. Supreme Court that limits shareholders ability to bring fraud-by-omission claims against public companies.
Mr. Goldstick earned his J.D., magna cum laude from Fordham University School of Law, where he served as Associate Editor of the Fordham Law Review. He earned his B.A. in History and a minor in Classical Archaeology from the University of Michigan.
