Chevron Survival Means Wage Regulations Live Another Day

“A U.S. Supreme Court decision not to review a case challenging Chevron deference means the U.S. Department of Labor and other federal agencies for now will avoid greater regulatory scrutiny, even as some attorneys say wage regulations often deserve heightened review.”
“There will be some that will be upheld no matter what because they’re probably a fair reading and there’s no need to second-guess the agency,” said Laurent Badoux of management-side firm Buchalter PC. “But there are others where the higher level of scrutiny will definitely cause those regulations to falter.”
