Buchalter successfully defends clients, Health in Motion LLC, and Leisure Fitness Equipment LLC, in a patent infringement case. Faced with a compelling motion for summary judgment, Plaintiff, Blackbird Tech, opted to (i) issue a covenant not to sue and (ii) file a motion to dismiss in order to avoid a finding of non-infringement. The Court subsequently reviewed Buchalter's motion for attorneys' fees, which are not typically granted, and awarded Buchalter’s clients all of the fees and costs requested (over $360,000).
