Buchalter’s litigation team, led by Rick Darwin and Peter Bales, obtained a trial victory on behalf of Comerica Bank in a breach of contract action. The Plaintiff, an accountant in New York, alleged that Comerica failed to pay for bookkeeping and accounting services based on an oral agreement the two parties made in 2010. In 2014, the Plaintiff sent Comerica his first and only bill in the amount of $1.7 million. Comerica denied the plaintiff’s allegations, asserted that the parties never reached an agreement, and presented evidence that it never received any work product from the plaintiff. After a four day trial in the United States District Court for the Eastern District of New York, the jury deliberated for 90 minutes before returning a winning verdict for the defense.
