“Perhaps one of the most dynamic areas of law faced by employers over the past few years is related to the legal use of marijuana. Until recently, only a few states had laws regarding to the legal use of marijuana. Now 39 states and the District of Columbia have some form of law for the legalized use of marijuana. To further complicate matters, the statutes and regulations found in various states differ in terms of the marijuana product that is used, who can use it and for what purpose (if propose is even needed), and what protections the user is afforded.”
