David Liu, CIPP/US, is a Special Counsel in the Firm’s Los Angeles and Orange County offices and a member of the Litigation and Cyber Security practice groups. David is Practice Co-Chair of the Cybersecurity Law Practice Group. David specializes in, among other things, cyber security, privacy litigation, class actions, mortgage lending and real estate

Specifically, David’s practice focuses on the defense of data breach class actions, mass arbitrations and individual actions involving state and federal privacy laws including CIPA, CCPA/CPRA, and CMIA.

David also counsels individuals, companies (including Fortune 500 companies), international transportation providers, banks and financial institutions—in complex commercial litigation and class actions; misappropriation of trade secrets; partnership, investor and shareholder disputes; business torts; contract claims; real property disputes; and federal government’s forfeiture actions for real property.

David was Co-Chair of his prior (Am Law 200) firm’s Cyber & Privacy Litigation Practice Group and joined Buchalter to continue with his prior successes and to take the next step on Buchalter’s platform which encompasses the entire West Coast and more than a dozen locations nationwide.

 

  • David obtained a CIPP/US from International Association of Privacy Professionals.
  • Analyze and counsel on data breach laws across states. Provide legal guidance to bank on actions to protect interests in licensed states in potential data breach matter.
  • Negotiated settlement with former client to obtain full amount of unpaid fees due after filing suit and nearly obtaining ex parte writ of attachment.
  • Prevailed on multiple motions to dismiss or demurrers, including actions based on lender liability, mortgage lending or loan servicing and non-judicial foreclosure actions. Representative cases include:
    • Leighton v. Blattner Techs. SVP 1, LLC (Orange County Superior Court, 2023) [represented defendant]; prevailed on motion to dismiss and to transfer action to Massachusetts court.
    • Miller v. Plex (U.S.D.C., Northern Distr. of Cal., 2023) [represented defendant]; prevailed on motion to compel arbitration based on defendant’s website’s terms of service.
    • McBain v. Flavorgod (Orange County Superior Court, 2020) [represented defendant]; prevailed on motion to be relieved from admissions based on prior defendant’s counsel’s representation.
    • U.S. Bank v. Rosenblum (San Mateo Superior Court, 2021) [represented bank]; prevailed on motion for summary judgment on partition action.
    • Cerda v. JPMorgan Chase Bank (U.S.D.C., Central Distr. of Cal. 2018) [represented bank]; prevailed on motion to enforce settlement for underlying claims alleging lender liability.
    • McMahon v. JPMorgan Chase Bank, N.A. (U.S.D.C., Eastern Distr. of Cal., 2017) [represented defendant bank]; prevailed on motion to dismiss with prejudice based on claims arising from California Homeowner Bill of Rights (HBOR), Equal Credit Opportunity Act (ECOA), Real Estate Settlement Procedures Act (RESPA) and state common law claims.
    • Arora v. Santander Holdings (Orange County Superior Court, 2017) [represented defendant bank]; prevailed on demurrer alleging multiple claims of fraud against bank.
  • Assisted in preparing successful Brief in Opposition in United States Supreme Court, Phar-Mor, Inc., v. McKeson Corp., No. 08-938 (certiorari denied), an Ohio bankruptcy litigation that was appealed to the Supreme Court.
  • Co-authored Respondent’s Brief in Theuson v. U-Haul Int’l, Inc., 144 Cal. App. 4th 664 (2006) which affirmed trial court’s favor of client.

Mr. Liu earned his J.D. from Loyola Law School and earned is Masters in Social Work & Science in Gerontology. He earned his B.A. in Social Work from California State University, Long Beach.
