Kripa Upadhyay will serve as a panelist at the 2026 America’s Property Exhibition (APEX), taking place on September 24, 2026, in Las Vegas, Nevada. She will participate in two panel discussions, “Cross-Border Capital Flow,” and “EB-5 Capital & Real Estate Projects Forum.”
Panel 1: Cross-Border Capital Flow
Kripa will focus on the intersection of immigration, foreign direct investment, and U.S. national-security regulation—the issues international investors need to consider before deploying capital into the United States. This includes CFIUS considerations and investments near sensitive sites; OFAC sanctions and source-of-funds tracing for investors from higher-scrutiny jurisdictions; and the often-overlooked impact of an investor’s U.S. immigration status on their ability to acquire and invest in U.S. real estate.
Panel 2: EB-5 Capital & Real Estate Projects Forum
Kripa will focus specifically on EB-5 as a source of foreign capital for U.S. real estate projects, including investor due diligence, source and path of funds, immigration considerations, and the evolving regulatory and policy landscape shaping the future of the EB-5 program.
Together, the panels reflect Kripa’s broader practice focus: advising foreign investors and U.S. businesses on the intersection of immigration and foreign direct investment—because moving capital across borders increasingly requires understanding more than just the investment itself.
