Jason Cagle is a Partner in the Firm’s Dallas office and a member of the Litigation practice group. Mr. Cagle focuses his practice on helping his clients resolve business disputes. He is Board-Certified in Construction Law in Texas and specializes in claims involving commercial construction and real-estate projects. Mr. Cagle has extensive experience in representing clients at all stages of dispute-resolution proceedings, including initial claims, discovery, mediation, trial, and arbitration proceedings. He works to help his clients solve complex problems arising from projects and properties in Texas and throughout the country.

In addition to his construction practice, Mr. Cagle represents businesses in commercial business matters, including contract disputes, employment matters, and bankruptcy claims. He has represented clients in a diverse range of industries, including oil and gas, manufacturing, food service, and hospitality.

Mr. Cagle collaborates with his clients to develop innovative strategies to accomplish their objectives. In addition to his litigation practice, Mr. Cagle serves as outside general counsel to businesses to help them anticipate and prepare for risks and potential liabilities. He advises clients on a diverse range of issues, including employment, insurance coverage, and general risk management.

Construction Disputes Between Owners and General Contractors

  • Defended a project owner against a state-court lawsuit by a design-build contractor for a manufacturing facility in Houston, Texas.
  • Represented a general contractor in a lawsuit by a neighboring landowner claiming property damage due to allegedly defective construction of a commercial building in Dallas, Texas.
  • Assisted with representation of a national retailer in a lawsuit against its landlord and general contractor concerning defective work on the exterior of a large store in a shopping center in the Dallas area.
  • Represented a developer in a state-court lawsuit and related bankruptcy proceedings against its business partners concerning mismanagement of an entertainment venue in Dallas, Texas.
  • Represented a general contractor in multiple lawsuits against the owners of several multifamily projects concerning delays and allegedly defective work in the Austin area.
  • Represented a general contractor in an arbitration against an owner and over 15 subcontractors concerning alleged defective construction of a multifamily building in Dallas, Texas.

Construction Disputes with Subcontractors and Suppliers

  • Represented a general contractor in an arbitration against a subcontractor concerning delays in fabrication and erection of precast concrete panels in construction of a large student-housing facility in Arizona.
  • Represented a general contractor in an arbitration against a concrete subcontractor regarding delays and defective work in the construction of a parking garage in the Houston area.
  • Represented a project owner in an arbitration against a steel fabricator concerning delays and defective construction of a manufacturing facility in Iowa.
  • Assisted with obtaining an arbitration award on behalf of a general contractor against a subcontractor for delays and defective electrical work during construction of an assisted-living facility in the San Antonio area.
  • Assisted multiple general contractors in proceedings in federal bankruptcy court to replace a bankrupt concrete subcontractor and defend against claims for additional payments.

Energy Sector Disputes

  • Assisted with prosecution of claims by an oil & gas development and operating company in an arbitration and a lawsuit concerning enforcement of rights to operate wells.
  • Represented a major pipe-fabrication contractor in a lawsuit against a project owner claiming noncompliant and defective work in the construction of a manufacturing facility in Washington.

Employment and Trade Litigation

  • Obtained dissolution of temporary restraining order in a lawsuit by a former employer against former employees who started a competing youth volleyball organization.
  • Obtained a temporary injunction in state court against a former employee of an excavation contractor who misappropriated the contractor’s confidential and trade-secret information in McKinney, Texas.
  • Assisted with defense of an oil & gas operating company in lawsuits claiming violations of minimum-wage and overtime requirements under the Fair Labor Standards Act in Texas and Montana.
  • Defended multiple affiliated restaurants in federal lawsuits claiming violations of minimum-wage requirements under the FLSA in Texas and Oklahoma.

Commercial & Fraud Litigation

  • Represented the developer of a high-rise condominium tower in a state-court lawsuit and a federal lawsuit asserting claims against its general contractor and architect concerning delays and allegedly defective construction in the Dallas area.
  • Assisted with prosecution of claims in federal court by a purchaser against a seller concerning fraudulent nondisclosure and inducement regarding the purchase of a shopping center located in North Carolina.
