Sarah Andrzejczak is a Partner in Buchalter’s Denver office and a member of the Firm’s Litigation and Labor & Employment Practice Groups. She serves as a commercial litigator and trusted adviser to businesses navigating employment disputes and complex business litigation in Colorado.

What distinguishes Ms. Andrzejczak’s employment practice is the breadth of her litigation experience. Rather than advising from the sidelines, she brings firsthand courtroom perspective to every counseling engagement — helping clients draft employee handbooks and enforceable non-disclosure and non-competition agreements, structure sound onboarding and offboarding practices, and anticipate the disputes that most commonly arise. She has counseled businesses across a wide range of industries, including technology, hospitality, professional services, and construction, and has defended employers through administrative agency proceedings and in federal and state court on matters involving discrimination and retaliation, wage and hour, and high-risk employee separations.

Beyond employment, Ms. Andrzejczak litigates a broad range of business disputes — from real estate and manufacturing to product contamination and technology. She has obtained favorable verdicts as first- and second-chair counsel in jury and bench trials in both state and federal courts. Her appellate experience — developed during her clerkship with the Honorable John Daniel Dailey of the Colorado Court of Appeals — extends to matters before the Colorado Court of Appeals and Colorado Supreme Court.

Her approach is direct and results-oriented: she develops legal strategies designed to resolve matters as efficiently and cost-effectively as possible, while building the kind of long-term client relationships that help businesses get ahead of problems before they escalate.

  • Represented seller in a breach of contract dispute arising from a contested commercial real estate transaction valued at nearly $10 million, involving competing claims over earnest money. Obtained summary judgment on all claims asserted against the client in Colorado state court, prevailed after a bench trial on the buyer’s counterclaims, and successfully defended all rulings before the Colorado Court of Appeals. Attorneys’ fees and costs were awarded to the client at both the trial and appellate stages.

 

  • Represented a Canadian manufacturer of agricultural processing equipment in a breach of contract dispute in Colorado state court after a cannabis grower stopped making payments under a financing agreement and countersued for $21 million, alleging the equipment destroyed its entire 2021 harvest. Following a three-day jury trial, the jury awarded the client the unpaid principal balance, 24% penalty interest, and six figures in attorneys’ fees and costs, while rejecting the buyer’s $21 million counterclaims in their entirety.

 

  • Member of trial team that obtained a $7.5 million verdict against Stryker Corporation following a two-week federal bench trial on claims of corporate raiding and breach of contract arising from a distribution agreement for orthopedic products. The verdict included $2.2 million in attorneys’ fees.

 

  • Represented a provider of enterprise software solutions for regulatory compliance and inventory management, named as a defendant in a federal court lawsuit seeking damages in excess of $4 million. Following the plaintiff’s case in chief at trial, successfully moved for a directed verdict on all claims against the client, with the court finding the evidence insufficient to submit any claim against the client to the jury.

 

  • Secured a $9,000,000 subrogation recovery through settlement on behalf of a global insurance carrier and co-carrier following extensive federal court litigation in Texas. The carriers’ insured, a canned food supplier, suffered a significant product contamination loss in Peru resulting from a vendor’s faulty production methods and materials.

 

  • Obtained summary judgment on behalf of a commercial property owner against its former manager, with the court finding the manager had committed widespread fraud and misappropriation. The court awarded damages of $1,028,183 plus attorneys’ fees and costs.

 

  • Recovered nearly $3 million on behalf of out-of-state farmers in a breach of contract action against a hemp processor that failed to process and sell hemp in accordance with a multi-year agreement.

 

  • Represented multiple Midwest amusement ride operators in separate federal court actions against a ride manufacturer that engaged in a pattern of fraud — collecting deposits for rides that were never built or delivered — and achieved favorable settlements on behalf of all clients.

 

  • Represented a business brokerage in a Colorado state court action against a seller and its owner for breach of contract and unjust enrichment after the seller terminated a pending transaction and refused to pay the earned brokerage commission. Secured a default judgment, successfully defended it when defendants moved to set it aside, and ultimately achieved a favorable settlement on behalf of the client.

 

  • Counseled multiple executives and entrepreneurs across industries including sales, technology, and financial services on navigating restrictive covenants following departures from former employers, enabling clients to successfully launch their own businesses while managing legal exposure.

 

  • Negotiated significant severance packages on behalf of two C-suite executives in separate contested departures from a national fitness company and a national nonprofit organization, respectively.

 

  • Defended a Colorado employer through parallel state and federal agency investigations arising from allegations of workplace sexual harassment, achieving a favorable resolution for the client.

 

  • Obtained a complete defense verdict for a national property management company in a Colorado state court jury trial involving a premises liability claim, and successfully defended the verdict on appeal before the Colorado Court of Appeals.

 

  • Obtained a complete defense verdict for a national book retailer in a Colorado state court jury trial involving a premises liability claim concerning the design and layout of bookshelves in the store.
