“Most Georgia attorneys, however, agree that the bills’ passage was just the opening salvo in a long battle that will soon shift to appellate courts.
‘Lawyers like to make issues out of definitions,’ said Buchalter PC‘s Brian Goldberg, a real estate litigator. ‘There’s a lot of definitions that were included, new definitions that have not been incorporated in any other statutes,’ he added, such as language requiring plaintiffs to show negligent security created ‘reasonably foreseeable risks.’
Goldberg flagged a recent decision from the Georgia Court of Appeals tossing a $140 million verdict against an Atlanta apartment complex as a harbinger of fights to come.”
