“A Jan. 16, 2024, note from Steven Floyd — then the sole named plaintiff in the suit — put Hagens Berman Sobol Shapiro LLP in a difficult position of “trying to thread the needle,” David J. Elkanich of Buchalter PC told U.S. District Judge Kymberly K. Evanson. While the firm was bound to follow the client’s wishes, he said, it also had an ethical obligation to ensure the client was making an informed decision.
The January communications “don’t define how Hagens Berman is supposed to react,” Elkanich said. “They don’t tell Hagens Berman what to do. They don’t tell Hagens Berman to dismiss the case that day.”
“What if they’d just dismissed it that night, and then Mr. Floyd comes back and says, ‘Hey, how’s our case going?'” Elkanich continued. “It would be a malpractice issue.”‘
