Jacob Rossman is a Senior Counsel in the Firm’s San Francisco office and a member of the Health Care and Litigation practice groups. He advises and represents health care providers in litigation with a focus on commercial and reimbursement disputes on behalf of hospitals, hospital systems, and other health care clients. Mr. Rossman also has expertise in federal health regulations concerning Medicare certification standards and health, safety, and quality-of-care enforcement against hospitals, skilled nursing facilities, hospices, home health agencies, and intermediate care facilities.

Mr. Rossman previously served as a senior attorney at the U.S. Department of Health and Human Services (HHS), Office of the General Counsel, Region IX, in San Francisco. He worked at HHS for seven years before joining the Firm. At HHS, he specialized in high-stakes enforcement cases on behalf of the Centers for Medicare and Medicaid Services. Mr. Rossman served as lead counsel in many of Region IX of HHS’s most complex and high-profile administrative litigation cases and federal cases. He also advised on Medicaid payment disputes with states and advised on hospital/operations matters involving the Indian Health Service. Before beginning federal service, Mr. Rossman worked for six years as an associate attorney practicing business litigation.

Health Care Regulation and Compliance

  • Obtained approximately 17 favorable decisions published by the U.S. Department of Health and Human Services, Departmental Appeals Board on behalf of the Centers for Medicare & Medicaid Services against health care providers and suppliers. These cases include the agency’s enforcement of health-and-safety standards, such as requirements for patients to receive quality health care services and to be protected from staff abuse, and enrollment standards implemented to prevent Medicare fraud and waste.
  • Defeated preliminary injunction motions and temporary restraining order applications in U.S. District Courts filed by health care providers seeking to continue to receive federal payments while they disputed actions to either terminate or revoke their Medicare agreements. Simultaneously received orders dismissing each of these actions for lack of subject matter jurisdiction.
  • Obtained multiple favorable decisions from the U.S. Equal Employment Opportunity Commission in full defense of the U.S. Department of Health and Human Services against employment claims respectively alleged by hospital staff and health program staff.
  • Reached favorable terms for the Centers for Medicare & Medicaid Services to successfully terminate the provider agreements of over 15 providers committing some of the most serious health-and-safety violations. These cases involved a range of different providers including hospitals, skilled nursing facilities, hospices, home health agencies, and intermediate care facilities for individuals with intellectual disabilities.
  • Negotiated and drafted complex systems improvement and settlement agreements permitting providers facing significant enforcement actions to continue to participate in the Medicare program in exchange for enhanced state and federal oversight, and the development of root cause analyses and action plans to substantially improve their quality of patient care services.
  • Represented the federal Medicaid program in many disputes with states and territories over federal financial participation involving multiple millions of dollars to hundreds of millions of dollars in federal funding.
  • Drafted and advised on multiple revisions and new subparts of federal health regulations on the subjects of Medicare surveys, certification, and enforcement, which the U.S. Department of Health and Human Services promulgated into law.

Business/Commercial Litigation

  • Obtained favorable arbitration defense judgment on behalf of drone manufacturer against foreign distributor alleging contractual breach of payment terms.
  • Prevailed in bench trial at the Alameda County Superior Court for breach of promissory note on behalf of a software company against former employee who failed to repay a company loan.
  • Obtained dismissal for forum non conveniens from the Marin County Superior Court on behalf of an American entrepreneur who purchased an estate and winery in a foreign country. The lawsuit involved an alleged realtor’s claim to a commission for the real property and business acquisition.

Mr. Rossman earned his J.D. from the University of San Francisco School of Law with a Certificate in Intellectual Property and Technology Law with Honors and served as an Articles Editor on the Intellectual Property Law Bulletin. He earned his B.A. from the University of California, Santa Cruz and graduated with Highest Honors in Politics.
