    • Anne Marie Ellis, Presents Webinar with Exponent on PFAS: A Scientific, Legal, and Regulatory Overview of Risk, Trends, and Best Practices

      • 11:00 AM

PFAS: A Scientific, Legal, and Regulatory Overview of Risk, Trends, and Best Practices

      Speakers

Anne Marie Ellis | Shareholder, Buchalter (Irvine, CA)
      Sarahann M. Rackl, Ph.D., P.E. | Exponent
      Brian Drollette, Ph.D. | Exponent

Per- and polyfluoroalkyl substances (PFAS) (aka forever chemicals) are an emerging concern for business. With legislation taking effect in 2023, companies need to understand their risks and compliance obligations, as well as potential legal actions.

PFAS are commonly found in various consumer products, including cookware, textiles, outerwear, and food packaging, and currently are at the forefront of environmental scrutiny by regulators, NGOs, and the media. There is a growing patchwork of laws that companies must comply with, including a significant cross-over with California’s Prop. 65. Additionally, even products and raw materials that claim to be PFAS-free may actually contain PFAS, especially in light of the varying and increasingly inclusive definitions of the term “PFAS”.

This webinar will provide an overview of the states and laws at the forefront of PFAS legislation, litigation trends involving PFAS, and practical tips for handling compliance throughout the supply chain. The presenters will discuss:

      • Evolving regulations and liability climate that is impacting consumer products
      • Strategies to address evolving compliance requirements and evolving liability risks
      • PFAS detection, quantification methods, and the challenges faced when adapting these methodologies to consumer products

    • Buchalter Sponsors Oxford University Quantum Information Society

Buchalter sponsors the Oxford University Quantum Information Society’s Event, “What is AQ and Why it will Impact Your World,” on October 26, 2022 from 4pm to 6:30pm at The Auditorium, Corpus Christi College, Merton Street, Oxford.

      About This Event:

The improvements in GPUs and AI in recent years along with developments in Quantum Technology (QT) are unlocking new, impactful solutions to societal challenges.

Quantum Computing (QC) is only a part of the Quantum Tech (QT) revolution now underway. Quantum sensing, quantum-safe communications and quantum simulation are three additional areas here today, each impacting our society in many ways, as recognized by Nobel Prize in Physics Is Awarded for Work in Quantum Technology.

By joining us you’ll learn from Jack Hidary, a recognized authority on the convergence of AI and QT, a union called ‘AQ’. He is author of the well-regarded textbook (Quantum Computing – An Applied Approach), and CEO of SandboxAQ, a firm he founded to apply AQ to solve problems enterprises are facing.

Jack will explore the consequences resulting from AQ. Over the next few years, we will start to see entire industries transformed by the confluence of AI and QT technologies delivering “access to tools with unexpected potential”, as the Nobel Prize committee put it.

One example comes from cybersecurity, where all companies face a challenge to protect their data, the lifeblood of their business. By attending you’ll learn actionable insights on Post Quantum Cryptography(PQC), whose goal is arming your organization’s cybersecurity systems for what’s invariably ahead.

In summary, if your professional future is linked to staying on top of tech innovation, you owe it to both yourself and your company to participate.

      Who Will Benefit from Attending?

Since joining Artificial Intelligence (AI) and Quantum Technology (QT) will make a substantial impact on society and commerce, this event is designed for a broad audience. The following groups will especially benefit:

      • Individuals involved in cybersecurity or interested in cryptography
      • STEM students intrigued by the emerging technologies at the intersection of maths, biochemistry, computer science, and physics
      • Business practitioners trying to stay informed on the latest tech approaching commercial viability

NOTE: This event will also be available On Demand. If you can’t make the time slot, register anyway and you’ll receive a link for the event recording so you can watch the material at your convenience.

Michael Flynn will speak on the topic of “Regulation Z: HOEPA and Higher-Priced Mortgage Loans (HPML) Requirements and Regulations” at Lorman Seminar on May 18, 2022

Understand the various requirements for loans that meet the HPML definition.
The Regulation Z Higher-Priced Mortgage Loan (HPML) rule imposes numerous detailed, specific, and often operationally-burdensome requirements on defined higher-priced mortgage loans. These requirements require significant operational and compliance oversight and can invoke secondary market investors and other requirements. While the HPML rule has been in place for several years, the myriad details and impacts of this rule warrant complete refresher updates for all persons who deal with the issue, as well as thorough training for new employees. This course will help those working in underwriting and loan origination activities, and all those responsible for adherence to and oversight of HPML requirements, to understand the definition of HPML and what loans meet the definition; as well as the various requirements for loans that meet the HPML definition, such as when escrow accounts must be utilized, and the appraisal requirements specific to HPMLs. The course will also help you understand what regulators and agencies can enforce the HPML rule and possible penalties for violations. Finally, you will learn about some of the interplays between the HPML rule and investor requirements and how the HPML rule overlays and interacts with the qualified mortgage rule and the high-cost mortgage rule.

Larry Steinberg will discuss “Tightening the Screws—Cataloging the New FTC Threats,” at the 2022 Direct Selling Legal & Compliance Summit, to be held February 17, 2022 in Austin, Texas.

In the wake of the Supreme Court’s unanimous Section 13(b) decision, the FTC has gone into penalty-seeking overdrive, looking for any tools that it can use to assert its power. Along with a desperate appeal to congress to codify 13(b), it is resurrecting the FTC Act’s Penalty Offense Authority, which would allow them to assess egregious penalties without due process. They are also pushing for a reversal to the direct selling exemption from the Business Opportunity Rule, which could be devastating to recruiting and enrollment. They are even changing how they create rules so they can make even more stringent ones.

In this informative session, our panel of experts explores the many ways the FTC is planning to challenge the channel, and how companies can prepare for what is certain to be a new era of screw-tightening.

Goldstein, have worked together at Buchalter for almost two decades representing insureds under title policies. Arrested Development: Law Firm Strategic Planning Around Junior Partners (Breakout)
Suffice it to say, the past twenty-four months have proven especially challenging for many junior law firm partners. Thanks to a global pandemic, many individuals struggled to establish a core book of business or build upon personal brands within an ever-evolving remote work environment and tepid business climate. Recent Harvard Law School research further attests to a generational shift among legal professionals toward greater work-life balance, alternative career pathways, and improved social awareness on the part of one’s employer, colleagues, or self. Viewed through a comprehensive lens, such headwinds augur a potential headache for law firm leaders and professional development peers. This session examines junior partner performance and professional development strategies for the modern COVID era. How does one address common professional, practical, and philosophical sentiments endemic to this key demographic?

      • 5:30 PM - 7:00 PM

Jeffrey Garfinkle speaks a panel on “Third Party Releases, Injunctions, and Exonerations in Chapter 11 Plans and Settlements” on October 21, 2021 from 5:30pm to 7:00pm

Non-consensual third-party releases – releases of liability that might be afforded to non-debtor persons with ties to a chapter 11 debtor’s estate – have long been the subject of important Circuit Court decisions. Undoubtedly, the availability of third-party releases has been venue-determinative for many large corporate chapter 11 cases that have confirmed plans centered on such relief. Most recently, mass-tort bankruptcy mega-cases have highlighted the significance of the availability, standards and opt-out mechanisms related to non-consensual third-party releases with political discourse on the topic now reaching a “fever pitch.” In the shadow of the Purdue Pharma bankruptcy case and hastily-drafted legislation pending before Congress, which could strictly limit Federal Court powers in this area, the panel will explore the status quo and discuss whether there are standards under which it would be beneficial for the Bankruptcy Code to expressly allow third-party releases in the context of a chapter 11 plan.

Oren Bitan and Jason Goldstein will discuss “Lending Issues in the Cannabis Industry: Managing Risk under State and Federal Law,” at the California Mortgage Association’s 2021 Summer Seminar on July 29, 2021 in San Diego, California.

A few short years ago, lending to the cannabis industry was limited to a few risk-taking private money lenders. Today, many states have legalized medical and recreational cannabis and leaders in the United States Congress are discussing its legalization, causing a substantial number of lenders, including credit unions, to begin to lend to the cannabis industry. In addition, a number of title insurers are willing to insure these loans. However, even if cannabis were to be legalized under Federal law, it is anticipated that there will be substantial Federal regulations, in addition to the existing state regulations, which will govern the cannabis industry. This program will provide you with guidance as to how you can enter this challenging market and navigate your way through Federal and state laws and regulations.

The CFPB has revoked its prior guidance limiting UDAAP exposure, indicating a likely intent to enforce UDAAP issues aggressively. The California Department of Financial Protection and Innovation’s UDAAP authority over FinTechs and debt collectors increases banks’ risk when they utilize the services of such companies. Explore these increased risks, and the need for ever stronger vendor management, compliance, training and other risk management oversight.

    • Manuel Fishman, Panelist at the BOMA San Francisco Webinar

      • 10:00 AM - 11:00 AM

Operating in a COVID-19 environment poses many challenges. Our traditional Management environment has been upended as eases may not reflect current COVID related impacts to operating expense pass-throughs. Some practices are evolving. How does one handle operating expense charges associated with COVID-19? How will you now “gross up” costs while occupancy is dramatically low, even while your building is technically fully leased? How does a tenant’s base year for the lease come into play? What is your plan for allocating COVID-related costs, incurred by the building and/or individual tenants? What lease provisions should you review or consider adding in new leases? Are there conservative, moderate and aggressive alternative methodologies to handling operating expense calculations? What are the relative merits of each alternative in the short and long term for ownership and management? Finally, how will you identify the calculation methodology which works best for your building and ownership?

With all the questions above and many more, join panelists Manuel Fishman (Buchalter) for a conversation.

Intellectual property is a hot area of the law, and businesses, along with individuals, are using intellectual property interests to start, grow and value their businesses. After the patent, trademark or copyright application is filed, most individuals and businesses think they are done with the process; however, some often overlooked interests, estate planning issues, can present significant problems in the future. A change in marital status, death and estate planning structure can all influence how intellectual property is owned, transferred and prosecuted worldwide. This topic will focus on several key points of convergence between the intellectual property world and the estate planning world. Small, mid-size and large businesses, along with business owners and individuals will benefit from this information.
