Why Trump's Gag Order Appeal Is Expected To Fail

"The chances of her ordering a stay are between zero and zero," former federal prosecutor Josh Robbins, co-chair of the white collar practice at Buchalter PC, told Law360. "Given that the trial is not far away and the threats are ongoing and have potential prejudice on the people involved in the process, the balance on the side of allowing the order to go into effect is stronger than it might be in other cases."

"Also, keep in mind that the Ford decision is not controlling here. It's a different circuit," Robbins noted. "So the D.C. Circuit and the district courts within it might approach gag orders differently."
