The U.S. Department of Labor missed its self-imposed deadline Wednesday to propose a rule updating the salary threshold for overtime, but attorneys said litigation and nominations could cause further delay.

"Their statutory framework of what they're looking to do, it's more than just the amount," Buchalter's Lively said. "It's the entire gamut. ... It can also include the duties, and it could include what way in which you must be paid in order to meet that salary basis test."
