"A bank urged a California federal court to reject an Everest Re unit's bid to toss part of a suit seeking directors and officers coverage, arguing that the insurer must face a claim that it be required to contemporaneously reimburse the bank for its expenses in underlying litigation.
Bank of Southern California NA said Friday that it should be able to continue its specific performance cause of action against Everest National Insurance Co. in addition to its claims for breach of contract and declaratory judgment."
