Few areas of the law are as closely tied to economic cycles, market disruption, and business decision-making as bankruptcy and restructuring. From high-profile chapter 11 cases to emerging insolvency trends and precedent-setting court rulings, developments in this field can reshape industries and influence stakeholders across the financial landscape. The Bankruptcy Litigation Blog was created to provide informed commentary on these developments and the practical issues they present.

Since its debut in October 2005 as the internet’s first bankruptcy-focused blog, this platform has served as a forum for examining significant cases, analyzing legal developments, and discussing the forces driving change in restructuring law and practice. During the financial crisis, the blog became a widely consulted source for timely analysis, drawing thousands of readers seeking insight into the Lehman Brothers, Chrysler, and General Motors bankruptcies and other landmark proceedings. More than 1.5 million page views later, its readership has included judges, practitioners, academics, and courts throughout the federal judiciary, including the United States Supreme Court.

What distinguishes the blog is its focus on context as much as outcomes. Beyond reporting developments, the blog focuses on cases and mega-case developments that would be of especial interest to insolvency practitioners, judges, and distressed investors because of the novel issues addressed. Over the years, the blog has highlighted emerging issues before they reached the mainstream, offered analysis of influential court decisions, and provided a space for thoughtful discussion within the restructuring community.

Nine years after my last post, I decided to restart the blog. The impulse is the same one I described when I launched the blog: a determination to stay current with the law as it develops, inspired by my mentor, Judge Diane Wood, while avoiding the all-too-common temptation to engage in pointless and incessant barking. As bankruptcy law continues to evolve, I look forward to continuing that conversation. I won’t pretend to know how often I’ll post or how long this experiment will last, but I hope each post proves worthy of a few minutes of your time.
