California’s Enhanced Non-Compete Ban: Implications for Employers

“Beginning January 1, 2024, a new California law may prohibit employers from enforcing non-compete agreements against former employees who become California residents, even in cases in which the employee signed the agreement outside California, the employer is based outside California, and the agreement is governed by another state’s law. Businesses and their HR (human resources) professionals will need to be keenly aware of employee moves as this issue becomes more settled.”
