Real Advantage Title Insurance Company Is Insolvent: Next Steps And A Learning Moment

By John L. Hosack, Jason E. Goldstein

California Insurance Commissioner Files Petition in the Superior Court to have him appointed as the Conservator of Real Advantage Title Insurance Company

On August 25, 2025, the California Insurance Commissioner filed a Petition in the Superior Court of Orange County, California and requested the Court to appoint the Commissioner as Conservator of Real Advantage Title Insurance Company (“RATIC”) on the ground that it was “…insolvent…”

RATIC, according to the Commissioner’s Petition, is licensed to transact title insurance in 30 states, including California.

According to RATIC’s website, it “…is a proud partner of the Orange Coast Title Family of Companies.”

According to the Commissioner’s Petition, on or about May 22, 2025, RATIC and the California Department of Insurance entered into a voluntary cessation of business whereby RATIC agreed that it and its policy issuing agents would cease, within 48 hours, from accepting new title orders in all states.

According to Demotech’s website, its Financial Stability Rating for RATIC was withdrawn on March 31, 2025.

If you have a policy of title insurance issued by RATIC, there are a number of things which you may want to consider, including, but not limited to, the following:

  • Should you obtain a new policy of title insurance?
  • If your policy was reinsured, do you have a direct access endorsement to your policy?
  • If you obtained your policy after March 31, 2025, when Demotech withdrew its Financial Stability Rating for RATIC, do you have potential claims against anyone?

The Commissioner’s Petition against RATIC shows the risks to insured in dealing with title insurance companies which are not financially strong.
