Alexandra (Alex) Shulman is a Shareholder and a member of Buchalter’s Labor and Employment and Litigation Practice Groups. Alex focuses her practice on representing businesses in complex and high-exposure employment disputes and providing strategic advice to keep her clients out of the litigation crosshairs. With a strong foundation in commercial litigation, Alex brings a business-oriented and tactical approach to sophisticated employment matters.

Alex has extensive experience defending employers in wage and hour class actions and collective actions involving claims of meal and rest period violations, off-the-clock work, pay transparency violations, and employee misclassification. Her class action practice is complemented by her work on single-plaintiff matters involving wrongful termination, discrimination, retaliation, and sexual harassment claims. Her ability to navigate multifaceted legal and factual scenarios is informed by her experience litigating complex business, commercial, and consumer fraud matters.

Alex’s litigation practice also includes handling temporary restraining orders (TROs) and preliminary injunction proceedings, particularly in matters involving misappropriation of trade secrets and breaches of noncompetition, nonsolicitation, and confidentiality agreements. She is well-versed in obtaining and opposing emergency injunctive relief in fast-moving, high-risk disputes that can significantly impact a business’s operations.

Beyond litigation, Alex serves as a trusted advisor to employers of all sizes on day-to-day employment law compliance. She counsels on hiring and termination practices, employee discipline, wage and hour issues, disability accommodations, protected leaves, privacy concerns, policy and handbook development, and workforce restructurings. Her guidance is tailored to mitigate legal risk while aligning with each client’s business objectives.

Trade Secrets, Non-Competes, and Unfair Competition

  • Obtained dismissal of trade secret misappropriation claims filed by a former employer against former employee and competing business in the District of Oregon.
  • Procured summary judgment on breach of contract claims involving alleged non-compete and non-solicitation violations in the District of Oregon.
  • Defeated a motion for temporary restraining order in a non-compete and trade secret case in the District of Oregon.
  • Secured favorable resolution of a trade secrets dispute brought by a former employer against competitor and former employees in the District of Oregon.
  • Prevailed on motion to dismiss trade secret misappropriation, unfair competition, and breach of contract claims in the Middle District of Alabama.

Wage and Hour / Class Actions

  • Lead defense counsel in numerous Washington State wage-and-hour class actions involving alleged missed meal and rest breaks and pay transparency claims.
  • Negotiated favorable resolution in a Fair Labor Standards Act (FLSA) misclassification collective action in the District of Oregon.
  • Defeated summary judgment motion in a FLSA collective action in the District of Arizona.

Discrimination, Retaliation, and Harassment Claims

  • Obtained defense verdict in a two-week jury trial in Multnomah County, Oregon on an $11 million whistleblower retaliation claim.
  • Successfully moved to dismiss employment discrimination claims based on criminal history screening, filed in Multnomah County, Oregon.
  • Obtained dismissal with prejudice of wrongful termination and sex discrimination claims in the Western District of Washington.
  • Prevailed on motion to dismiss disability discrimination and failure-to-accommodate claims in the District of Oregon.
  • Achieved voluntary dismissal of disability discrimination and retaliation claims following motion to dismiss in the District of Oregon.
  • Obtained summary judgment on gender discrimination claim in the District of Oregon.
  • Secured summary judgment in a case involving disability discrimination and sexual harassment in the Middle District of Alabama.
  • Achieved dismissal or “no cause” findings for dozens of complaints before the Equal Employment Opportunity Commission (EEOC), Oregon Bureau of Labor and Industries (BOLI), Washington State Department of Labor & Industries (L&I), and Washington State Human Rights Commission (WSHRC).

Consumer Protection and Other Complex Litigation

  • Secured voluntary dismissal of a $200 million putative trespass class action in the District of Oregon.
  • Prevailed on appeal in the Oregon Court of Appeals in a consumer protection class action lawsuit.
  • Prevailed on appeal in the Oregon Court of Appeals in a consumer protection case brought by the State of Oregon.
  • Secured full summary judgment and dismissal in a breach of contract and trespass dispute in the District of Oregon.
