David A. Bernstein is an attorney in the Firm’s Portland office and a member of the Litigation practice group. He represents companies, professionals, and institutional lenders in commercial, professional responsibility and liability, intellectual property, and other civil disputes.

Mr. Bernstein has deep experience advising financial institutions on complex commercial matters, including loan enforcement and receivership litigation. He also defends attorneys, fiduciaries, and other professionals in malpractice claims, fee disputes, and disciplinary proceedings, and regularly counsels on legal ethics and risk management.

He has worked extensively with pharmaceutical and medical device companies, hospitals, medical professionals, and insurers to resolve high-stakes litigation. His regulatory practice includes licensure litigation and compliance counseling, with experience in the medical marijuana and hemp sectors.

Mr. Bernstein previously clerked for the Honorable Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia. Before joining Buchalter, he practiced for seven years at a national law firm headquartered in Cleveland, Ohio.
