Elizabeth Murphy is a Partner in the Firm’s Dallas office and a member of the Labor & Employment practice group. For over 30 years, Ms. Murphy has supported employers in all aspects of their employment obligations, focusing on prevention and compliance with California’s complex and layered rules related to (among other things): pre-employment testing and privacy; onboarding; discrimination, harassment, retaliation and bullying prevention; pre-employment arbitration and other contractual obligations; mandated notices and policies; leaves of absence; wage hour and payroll compliance; discipline and other issues that arise during employment; and terminations, layoffs, resignations and related end-of-employment issues. Ms. Murphy also defends employers in legal actions brought by employees before California and federal courts, arbitration tribunals, and governmental agencies such as the California Civil Rights Department, the Department of Industrial Relations, the Occupational Safety and Health Administration, the Employment Development Department and their federal counterparts (the Department of Labor and the Equal Employment Opportunity Commission). These post-employment claims usually involve individual and/or collective disputes related to wage hour issues and various theories of alleged wrongful termination.
Ms. Murphy has developed a specific emphasis in field of “home care,” which includes medical and non-medical in-home care, hospice care, various levels of nursing and other skilled-care, Residential Care Facilities for the Elderly, domestic referral agencies, medical staffing companies, vendors of the California Regional Centers, and facilities that care for those struggling with mental and addiction-related issues. Ms. Murphy is a frequent speaker for the California Association of Health Care at Home, the California Regional Center Association, and various groups and associations of home care providers.
Ms. Murphy’s clients include home-care franchisees, franchisors, independently owned, and other providers of home and other senior care. Ms. Murphy also represents employers in fields related related to real estate, technology, manufacturing, retail, and hospitality.
