Lilly Lentz is an Associate in the Firm’s Denver office and a member of the Litigation practice group. Ms. Lentz’s primarily focuses her practice (in addition to general complex commercial litigation) in litigation involving construction defects and real property disputes. Ms. Lentz’s practice encompasses claims involving failure to pay, delay and liquidated damages, premises liability, construction defects, various breaches of AIA contracts, easement and quiet title disputes, partition actions, fraud, failure to disclose, trust fund violations, civil theft, mechanic’s liens, commercial and residential lease disputes, HOA litigation, and fair housing compliance. Ms. Lentz’s real estate and construction practice encompasses representation of developers, builders, homeowners, commercial property owners, general contractors, subcontractors, buyers, sellers, title companies, and banking institutions. 

Additionally, her practice includes a wide variety of advocacy and courtroom experience, including jury and court trials, arbitration, and mediation. For her general complex commercial litigation practice, she defends and prosecutes actions involving contract disputes, breach of fiduciary duty claims, business torts (including fraud, civil theft and unfair competition), probate litigation, and employment.

  • Advise developers and real property owners on matters concerning corporate and organizational issues, including fair housing compliance, commercial lease provisions pertaining to indemnity and hold harmless clauses, and maximizing organizational structures to mitigate risk and protect assets
  • Service as outside litigation counsel, working closely and collaboratively with in-house counsel for large corporations
  • Defend property owners against allegations of fair housing violations involving Americans with Disabilities Act claims and fair housing violations involving construction defects and accommodation requests of employees and tenants, both against private individuals and administrative agencies
  • Defend against overreaching discovery requests involving confidential client information, including trade secrets, company financial statements, and ownership structures
  • Defend insured entities against insurance carriers in coverage disputes and tenders of defense to and from third parties; navigate complex issues arising out of “insurance stacks”
  • Litigate enforceability of liquidated damages clauses and consequential damage waivers in AIA construction contract for a ~$20 million matter
  • Successfully secure favorable settlement in multi-million-dollar cases on behalf of owner/developers, including senior living homeowner and residential multi-family owner
  • Regularly perform extensive title and survey reviews in quiet title matters, including partitions in kind and by sale, adverse possession, easement disputes, and in premise liability cases
  • Negotiate initial and amended commercial leases and vendor agreements; pre-litigation negotiations of commercial lease disputes
  • Work closely with experts on nearly every case for both plaintiffs and defense; negotiate contracts on behalf of clients regarding the same
  • Prepare witnesses for, and take and defend numerous C.R.C.P. 30(b)(6) and fact witness depositions
  • Litigate complex probate matters including trust disputes involving real property held in trust with unique tax implications
  • Defense of malpractice actions and COCCA claims
  • Voluminous affirmative and defensive motions practice, for example: motions to dismiss, motions to compel production, motions to compel arbitration, discoverability of financial information, arbitrability of claims, choice of law and summary judgment
  • Present argument at evidentiary hearings pertaining to Rule 37 sanctions and other discovery disputes, contempt, and fees and costs awards; several successful fee awards and discovery disputes
  • First chair at arbitration hearings for several matters, including construction defect resulting in favorable award and examination of multiple experts
  • First chair in partition action resulting in favorable Order and Judgment; secured a discretionary fee award through creative argument
  • First chair in commercial contract dispute involving high-profile matter followed by the Aspen Times
  • Lead/solo counsel for clients at multiple successful mediations, including matters concerning failure to disclose material defect, probate litigation involving fraud and civil theft, and a commercial lease dispute involving HVAC design flaws
  • Representation pertaining to various facets of business-related disputes encompassing receiverships, dissolution, advising executive team and director-level management regarding contracts, business and employment practices and dispute avoidance and resolution
  • Advisement to businesses in highly regulated fields, including cannabis, food & drug, and gaming
