$100K H-1B Fee Could Sow Seeds Of Innovation Abroad

“Despite the Trump administration emphasizing the strategic importance of beefing up semiconductor and AI ventures in the U.S., the $100,000 fee could undermine the ability of U.S. startups to get or keep the talent they need, according to Buchalter shareholder Kripa Upadhyay.

The attorney told Law360 she has represented multiple startups and startup founders who are on H-1B visas, and is currently representing foreign students who are trying to self-sponsor H-1B visas because they have angel funding — early money from individual backers — or Series A funding from major venture capital firms to start businesses in the U.S.”
