Buchalter recently obtained a significant attorneys’ fees award for their Louisiana-based baby products client, Nuby, in a hotly contested, five-year-long patent and trademark case against a large Los Angeles-based competitor, Munchkin. After Nuby’s team convinced the Patent Trial and Appeal Board to invalidate Munchkin’s patent via inter partes review, Magistrate Judge John E. McDermott of the Central District of California issued judgment in Nuby’s favor in the underlying action. Following significant briefing and argument, Judge McDermott found that the case was “exceptional” and awarded Nuby $1,108,725 in attorneys’ fees and costs. Nuby called it a “significant decision” in the world of exceptional cases and noting that if published, the opinion would likely be quoted in future motions involving attorneys’ fees awards.
