Discussions regarding the validity of noncompete agreements reached a fever pitch in 2024 following the Federal Trade Commission‘s April effort to prohibit noncompete agreements in the employment context. Those discussions were turbocharged in late August by the subsequent injunction of the FTC’s new rule by the U.S. District Court for the Northern District of Texas.
Of course, in California, noncompete agreements are generally invalid, except under certain circumstances, and have been for some time.
