 Executive Summary

The California Assembly Appropriations Committee passed AB5 along party lines. The bill now moves to the Assembly at large for consideration.

Analysis

On May 16, 2019, California Assembly Appropriations Committee passed the AB5 as amended on May 1, 2019. Votes were as follows:

Ayes

Richard Bloom (D) – 50th Assembly District

Rob Bonta (D) – 18th Assembly District

Lisa Calderon (D) – 56th Assembly District

Wendy Carrillo (D) – 52nd Assembly District

Edwin Chau (D) – 49th Assembly District

Susan Talamantes Eggman (D) – 5th Assembly District

Jesse Gabriel (D) – 46th Assembly District

Eduardo Garcia (D) – 36th Assembly District

Lorena Gonzalez Fletcher (D) – 80th Assembly District

Brian Maienschein (D) – 76th Assembly District

Cottie Petrie-Norris (D) – 73rd Assembly District

Bill Quirk (D) – 20th Assembly District

The bill will now move to the California Assembly at-large for consideration.

Looking Forward

Again, it is not surprising that this bill was passed along party lines with Assemblyperson Mike Fong the lone exception. The bill now moves to the floor where it would be shocking if more debate and carve outs do not occur given the inadvertent impact the “ABC” test will have on numerous industries. Unfortunately, based on its current composition, it is unlikely that the Assembly amends the bill to include a carve out for franchising.
