
Brian Goldberg is a Shareholder in the Firm’s Atlanta office and a member of the Litigation practice group. He concentrates his litigation practice on complex commercial and business disputes, real estate litigation, landlord/tenant disputes, creditor-rights litigation, lender-liability defense, professional liability, and premises liability litigation. Mr. Goldberg also has extensive experience litigating complicated bankruptcy disputes and adversary proceedings in Georgia and other jurisdictions.
Mr. Goldberg has successfully represented a wide range of clients including publicly traded companies, national banks, mortgage servicers, property management companies, small businesses, investors, and individuals in state and federal court in civil litigation including trying cases successfully as first-chair to jury trial. Mr. Goldberg enjoys helping his business owner clients resolve complicated business disputes and assisting creditor and/or landlord clients recovering property and money or working out defaulted loans and leases. Mr. Goldberg also has significant experience with residential and commercial property foreclosures, title disputes, and eviction/dispossessory issues. He is a trusted advisor to many clients on matters involve various types of real estate litigation including quiet title actions, boundary disputes, partition lawsuits, and resolution of complex title issues.

- Successfully represented a real estate investment company in a 3-day federal court jury trial, securing a verdict for specific performance that awarded $2 million in property, over $300,000 in lost rental income damages, and more than $150,000 in attorneys’ fees.
- Successfully represented and defended a real estate investment company in a bankruptcy adversary proceeding challenging the transfer of a $500,000 property, achieving a favorable settlement for the client.
- Successfully represented one of the largest private equity firms in the world in dispute in State Court and obtained complete dismissal for lack of personal jurisdiction.
- Successfully represented mortgage lender in defending against foreclosure-related claims brought by a borrower in federal court. Obtained dismissal of all claims at the district court level under Rule 12(b)(6), which was subsequently affirmed by the Eleventh Circuit Court of Appeals.
- Successfully represented real estate agent and real estate brokerage in a complex real estate dispute in Forsyth County Superior Court involving claims of negligence, malpractice, and unjust enrichment. Secured a highly favorable settlement.
- Successfully represented lawyer and law firm defendants in a civil action in Cobb County Superior Court. Obtained dismissal of all claims against them for failure to state a claim and failure to prosecute due to lack of service.
- Successfully represented real estate investment company in a breach of contract dispute in Henry County State Court against a contractor who abandoned a renovation project. Successfully obtained judgment for the client following a bench trial. The defendant’s counterclaims were withdrawn prior to trial.
- Successfully represented homeowners in a dispute against their homeowners’ association regarding the enforceability of assessments and fees under the subdivision’s declaration. Successfully obtained summary judgment at the trial court level, barring the HOA’s claims based on binding admissions. The Georgia Court of Appeals affirmed the decision, solidifying the homeowners’ position and preventing further collection efforts. Additionally obtained an award of $30,000 in attorney’s fees which was also held up on appeal.
- Successfully represented real estate brokerage and agent in a real estate dispute in Newton County Superior Court involving claims brought by a pro se plaintiff seeking to enforce a failed home purchase contract. Successfully obtained dismissal of all claims with prejudice.
- Successfully represented Defendant by obtaining dismissal of all claims, then dismissing Plaintiffs’ appeal in Cobb County Superior Court by arguing that the Plaintiffs’ delay in paying appeal costs was unreasonable and inexcusable under O.C.G.A. § 5-6-48(c). Additionally, established that pro se Plaintiff could not represent LLC in a court of record. The court granted the motion to dismiss the appeal and awarded in attorney’s fees under O.C.G.A. § 9-15-14(b), finding that the appeal lacked substantial justification and was intended for delay. Obtained a bill of peace in the same proceeding preventing litigious pro se party from filing any further proceedings without court permission.
- Successfully represented a private lender in securing summary judgment against a commercial debtor, resulting in a monetary judgment exceeding $250,000.
- Successfully represented a homeowner in a breach of warranty of title dispute, obtaining a monetary judgment of over $120,000 against the defendant.
- Successfully represented a petroleum supplier in a dispute with a competitor over permanent covenants, achieving a favorable resolution.
- Represented national bank in numerous foreclosure matters on residential and commercial properties.
- Represented publicly traded company in numerous dispossessory/eviction matters.
- Represented major automobile dealership with favorable result in dispute over car title and dispute over fraudulent security interest.
- Represented numerous real estate investors to successfully quiet title against properties purchased at tax sale after barring right of redemption.
Mr. Goldberg earned his J.D. from Mercer University – Walter F. George School of Law. He earned his B.A. in Psychology from Georgia State University, magna cum laude w/ advanced honors.
