Jonathon Talcott is a Shareholder in the Firm’s Scottsdale office and a member of the Intellectual Property practice group. Mr. Talcott is an experienced intellectual property counselor, litigator, and trial attorney. He specializes in high stakes litigation in all areas of intellectual property (IP), representing clients throughout the country in patent, trademark, trade secrets, copyright, Internet domain name, and other technology-related commercial disputes. He also regularly assists clients in building and maintaining their IP portfolios, and advises on IP and technology issues arising in various commercial transactions, such as licensing and M&A deals.

Mr. Talcott has a firm grasp on technology from his education in physics and electrical engineering, and from his years of practice as a professional engineer at a large aerospace and defense company where he designed displays and controls for cockpit electronics. His experience spans a broad range of technologies and industries, such as software and hardware for computers, consumer electronics, the Internet, financial institutions, cannabis, medical systems, sports equipment, and generative artificial intelligence (AI).

Mr. Talcott’s trademark practice includes advising on branding issues, securing and maintaining trademarks through the USPTO, and litigating trademark rights in federal courts and the Trademark Trial and Appeal Board. He has extensive experience in the advisement and litigation of trade secrets and copyright issues, particularly involving software. As a registered patent attorney, he enforces clients’ patent rights and defends clients against patent infringement claims, including from patent “trolls.” He also regularly advises clients on obtaining patents and maintaining patent portfolios.

Mr. Talcott prides himself in serving the community through his pro bono practice. He has served for many years on the Arizona Technology Council as a voluntary board member. He participated in the American Bar Association’s Clemency Project 2014, where President Obama granted his clemency petition for a low-level, nonviolent drug offender. He also represented a U.S. Air Force staff sergeant in a lengthy court battle against an HOA, vacating a judgment for garnished wages entered against the sergeant while he was deployed overseas.

Mr. Talcott has represented many large and small businesses, ranging from large technology companies and national retailers to innovative startups and non-profits. His matters have included:

  • Co-chaired trial team in District of Delaware to defeat $400+ million claim of infringement on patents for allowing web designers to integrate third-party services into their websites. Performed cross-examination of key infringement expert and direct examination of client engineer witnesses. Lead scribe on successful summary judgment motion for non-infringement on separately asserted set of website building patents.
  • Advised Arizona clients in all areas of technology and IP law, advising on novel contract terms, corporate policies, licenses, and litigation issues involving AI, particularly with generative AI such as ChatGPT.
  • Represented a closely held employee relocation services company in hotly contested software trade secrets dispute against competitor, successfully arguing against motion to dismiss before federal court in Minnesota.
  • Represented a charitable non-profit health care institution in bet-the-company breach of contract and business torts dispute with major hospital network, securing favorable settlement.
  • Secured voluntary dismissal of claims and early exit from national patent enforcement campaign centered in Western District of Texas against prominent automotive component suppliers and tire retailers.
  • Achieved extraordinary settlement for major golf equipment retailer in a patent infringement lawsuit against competitor involving 23 patents for golf equipment. Led multiple co-pending IPR proceedings before the Patent Trial and Appeal Board (PTAB). Deposed and defended key engineering and expert witnesses.
  • Secured preliminary injunction barring competitor from using major national tire retailer client’s name in Georgia and Florida locations. Prepared key expert reports and defended expert depositions. Made law in the Southeast protecting one of the Country’s most prominent trademarks.
  • Represented major national tire retailer in complex bet-the-company patent litigation, with a nationally reported successful result involving a complete walkaway by plaintiff in the face of a summary judgment. Served as lead scribe on motion obtaining extraordinary win transferring venue from the Eastern District of Texas to the District of Arizona, the client’s home turf.
  • Secured final judgment and permanent injunction against European cybersquatter in internationally reported case that preserved ownership of famous client museum name in the renowned Florence Museum. Obtained full award of attorney’s fees for client.
  • Served as lead scribe on successful summary judgment in nationally followed declaratory judgment action concerning Section 101 unpatentability regarding several patents covering common business methods surrounding email technologies. Obtained favorable deposition testimony from key technical witnesses to achieve same.

Mr. Talcott earned his J.D. from Arizona State University, Sandra Day O’Connor College of Law, and his M.S.E.E. in Electrical Engineering from the University of California – San Diego. He earned his B.S. in Physics and Astronomy from the University of Iowa, graduating summa cum laude with honors.
